2.1 Eligibility: You must be at least 18 years old (the legal age of majority in Australia) to use the Service.

2.2 Account Security: You are responsible for keeping your login credentials private. You are responsible for all activity under your account, including unauthorised access resulting from a failure to keep credentials secure. Notify us immediately at support@kylokit.io if you suspect a security breach.

2.3 Single User Account: Each account is for a single user or business. Creating multiple free accounts to bypass plan limits is prohibited and may result in immediate termination.

You agree not to use the Service to:

• Send spam, bulk unsolicited communications, or non-compliant email campaigns.

• Promote illegal goods, services, or activities.

• Distribute malware, phishing pages, or fraudulent content.

• Harass, defame, or harm any person or group.

• Violate any applicable local, national, or international law or third-party rights.

• Attempt to gain unauthorised access to our systems, servers, or networks.

• Resell, white-label, or sublicense the Service without prior written authorisation.

We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice.

You retain full ownership of the content you create or upload to the Service (funnels, emails, courses, landing pages, contact lists). By using the Service, you grant us a limited, non-exclusive licence to host, store, back up, and display that content solely for the purpose of providing and maintaining the Service for you.

You are solely responsible for your content and for securing all rights, permissions, and legally required consents from your subscribers and customers.

• 5.1 Fees: Paid plans are billed in advance on a recurring monthly or annual basis. Prices are listed on our pricing page and are subject to change with advance notice.

• 5.2 Auto-Renewal: Paid plans auto-renew automatically until cancelled. You can cancel at any time via your account settings. You will retain full access through the end of your current billing period.

• 5.3 Refunds: Except where required by non-excludable laws (such as the Australian Consumer Law), payments are strictly non-refundable. Please utilise free plan tiers or trial options before upgrading to a paid plan.

• 5.4 Taxes: All listed prices are exclusive of applicable taxes (such as GST or local sales taxes) unless explicitly stated otherwise. You are responsible for any taxes associated with your subscription.

The Service, its original content, design, software code, features, functionality, and branding (excluding your content) are owned by KyloKit.io and its licensors and are protected by Australian and international copyright, trademark, and intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any portion of the Service.

You may cancel your account at any time. We reserve the right to suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or use the Service in a manner that creates legal liability or disruption for us, our users, or third parties.

Upon termination, your right to access the platform ends. We reserve the right to delete your stored content after a reasonable grace period. You are responsible for exporting your data prior to account cancellation.

To the maximum extent permitted by applicable law (including the Australian Consumer Law), the Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that access will be uninterrupted, error-free, completely secure, or that specific business outcomes or revenue targets will be achieved.

To the maximum extent permitted by law, KyloKit.io’s total liability arising out of or related to your use of the Service is limited to the total amount paid by you to us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or data.

We may modify these Terms from time to time. Material updates will be notified via email or in-app notice at least 14 days before taking effect. Continued use of the platform after changes become effective constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of Victoria, Australia, without regard to conflict of law principles. Any legal action or dispute arising under these Terms shall be submitted exclusively to the jurisdiction of the courts located in Victoria, Australia.
